The Petition for Relief from Financial Obligation brought by Petitioner Jesus A. Collazo Ortega was last heard on 7/7/22. On that date, the court ordered Petitioner to file a proof of service “to demonstrate adequate service of this Petition on Respondent Data Mortgage, Inc. dba Essex Mortgage, as required by Mil. & Vet. Code §409.3(b).” (ROA 13)

Petitioner filed a Proof of Service for other documents not including the Petition. (ROA 16) Moreover, the Proof of Service showed that Respondent was served 2 days before the continued hearing date. “The petition shall be served at least 10 days before the hearing. The respondent shall file and serve a response to the petition at least five days before the hearing.” (Mil. & Vet. Code §409.3(b)).

The court will hear from Petitioner at the hearing.
