Tentative Decision in Zabounian v. Bejarno, 19 STCV30244

The matter is here on Defendant’s Motion for Summary Judgment.  The parties requested a continuance of the hearing to a specially set date, which was denied.  The basis for the request was that Plaintiff needed to do additional discovery to address the summary judgment motion.  The Court recommended instead that the parties reserve the next available MSJ date and continue the trial to at least 30 days past that date.  As of today’s date, the parties have not done as the Court recommended.  Accordingly, the Court is prepared to rule on the summary judgment motion as it now stands unless a party can convince the Court that it should not do so.  Under that paradigm, Defendant will have, through its motion, met its prima facie case to establish no triable factual issue.  Plaintiff, with no opposition on file, will have failed to rebut that showing by Defendant.
