CASE NO.: 22STCV04956

[TENTATIVE RULING]

MOTION TO CONTINUE IS DENIED

Dept. 27

1:30 p.m.

June 6, 2025

On February 8, 2021, Plaintiff filed this case. Trial is currently set for July 14, 2025. Defendants move to continue the trial to September 2025.

The basis for the requested continuance is that one of Plaintiff’s retained experts is unavailable for trial. In addition, lead trial counsel for Defendants, Robert T. Bergsten, is scheduled to begin trial in Los Angeles County (Hasid, et al. v. Suzuki Motors of America, Inc., et al., Case No. BC640943) on March 12, 2025. That matter is a long cause, five-year statute case, and counsel anticipates being engaged through at least April 12, 2025.

However, the Court has already continued the trial date from May 2025 to July 14, 2025. The unavailability of Plaintiff’s expert and the scheduling conflict with counsel’s March–April trial are no longer applicable. Accordingly, the motion is denied as moot.

Parties who intend to submit on this tentative must send an email to the Court at SSCDEPT27@lacourt.org indicating intention to submit on the tentative as directed by the instructions provided on the court’s website at www.lacourt.org.  Please be advised that if you submit on the tentative and elect not to appear at the hearing, the opposing party may nevertheless appear at the hearing and argue the matter.  Unless you receive a submission from all other parties in the matter, you should assume that others might appear at the hearing to argue.  If the Court does not receive emails from the parties indicating submission on this tentative ruling and there are no appearances at the hearing, the Court may, at its discretion, adopt the tentative as the final order or place the motion off calendar.
