Ruling:                     DEFENDANTS’ MOTION FOR TERMINATING SANCTIONS IS GRANTED¿

The motion for terminating sanctions was originally heard on March 12, 2024, at which time the court tentatively granted the motion. Plaintiff’s counsel requested to be and heard and alleged that he is experiencing certain health issues. Consequently, the court continued the hearing to March 18, 2024, and required Plaintiff's counsel to submit a declaration containing: A) Details about the health issues faced by Plaintiff’s counsel; B) Evidence of attempts made by Plaintiff’s counsel to secure an associate or substitute attorney; and C) A proof of service for the discovery documents Plaintiff purportedly had submitted to Defendant. Plaintiff's counsel did not submit a declaration and failed to follow the court's orders, despite this being the second chance given to the Plaintiff to evade terminating sanctions. Plaintiff's disregard for the court's directives suggests that lesser sanctions would not effectively deter future violations. Thus, Defendants’ motion for terminating sanction is GRANTED.
