In the present motion, Defendant Khandler Justin Kimber moves to compel
Plaintiff Manuel Antonio Orellana to appear for a deposition and produce
requested documents. Also at issue is whether the deposition should proceed in
person or virtually. On May 7, 2025, Plaintiff filed an opposition, informing
the Court that he has filed a motion for protective order concerning the
location and/or method of his deposition, which is scheduled to be heard on
June 9, 2025. Defendant requests that the Court continue the present motion to
be heard concurrently with the motion for protective order, given the
substantial overlapping factual and legal issues. The Court finds good cause to
continue the motion so that the motions can be heard on their merits and to
avoid conflicting rulings.
