The Court hereby adopts the reasoning of its tentative ruling from October 24, 2024, and denies the motion to dismiss.  The Court maintains its view that the 5-year statute runs on November 24, 2024. 

The Court finds that both parties have acted within the boundaries of fair and appropriate argument and declines to award any sanctions.
