TENTATIVE ORDER

 

Defendant/Cross-Complainant REDIGER INVESTMENT MORTGAGE FUND’s Motion to Compel the Second Session of the Deposition of Plaintiff PETER T. NORWICH is GRANTED.

 

Moving Party to give Notice.

 

Under CCP §2025.610 the Court can grant leave to allow a second deposition if there is good cause.

 

Defendant argues Plaintiff’s second deposition is warranted because at Plaintiff’s initial deposition on April 21, 2022, Plaintiff revealed additional information not previously disclosed in discovery. Based on this new testimony, Rediger subpoenaed the Los Angeles County Sheriff’s Department and obtained related police reports. Rediger argues that it should be able to examine Plaintiff about the documents/bank records that the subject subpoena produced (after Plaintiff’s initial deposition occurred).

 

The Court notes that the Los Angeles County Sheriff’s Department was unable to produce unredacted documents until after the December 8, 2022 hearing in this Court.

 

The Court finds that good cause has been shown, and the Motion is GRANTED.

 

Plaintiff PETER T. NORWICH is ORDERED to appear for a second deposition. The parties shall meet and confer to determine the date, time, and location of the deposition, which shall take place no later than 10 days from the date of the Court’s issuance of this Order. The date may be extended by agreement of the parties. This second deposition shall not exceed 2 hours and 15 minutes in length.
