20NWCV00268 PEDRO PEREZ, et al. vs PATRICK VALDEZ,

Defendant Valdez’s ex parte application requesting clarification of the court’s May 4, 2022 order is GRANTED.  To clarify, the motion requested the Court to dismiss Plaintiff Perez’s Complaint and strike Perez’s Answer to the Cross-Complaint.  (Motion, 9:6-8.)  Therefore, on May 4, 2022 the court granted terminating sanctions as to both Plaintiff’s complaint and Cross-Defendant’s answer to the cross-complaint. 

IT APPEARING TO THE COURT THAT THROUGH INADVERTENCE AND CLERICAL ERROR THE MINUTE ORDER OF MAY 4, 2022 IN THE ABOVE ENTITLED ACTION DOES NOT PROPERLY REFLECT THE COURT’S ORDER, SAID MINUTE ORDER IS AMENDED NUNC PRO TUNC AS OF THAT DATE AS FOLLOWS:             

BY ADDING:  The Plaintiff’s first amended complaint, filed on December 14, 2020, is dismissed, and Cross-Defendant’s Answer to the Cross-Complaint, filed on January 12, 2021, is stricken.

Defendant is directed to re-file its request for entry of default on the cross-complaint.  Moving Party to give notice.
