Doe v. The Salvation Army, 20STCV13393

 

This childhood sexual assault action was filed on April 6, 2020. Trial is scheduled to begin on June 16, 2025 in Dept. L. Plaintiff's Motion to Compel Deposition of Defendant's PMK (filed on April 18, 2025) is scheduled to be heard after trial on December 17, 2025. 

 

Plaintiff now moves ex parte for an order to continue trial, indicating that "[a]lthough the case did not settle at the mediation, the parties, the mediator and the relevant insurers.... have remained engaged in settlement discussions." (Notice 2:3-15.) 

 

On May 19, 2025, all parties executed a Joint Stipulation to Continue Trial to a date on or after September 2025, which is attached as Exhibit 1 to this Ex Parte Application.

 

Per Stipulation of the parties, Plaintiff's Ex Parte Application to Continue Trial and All-Related Deadlines is GRANTED. Depending on the Court  and parties' availabilities, a continuance of trial to a date on or after September 2025 is reasonable. The Court will confer with the parties to select new FSC and Trial dates. 

 

The Court notes that a Notice of Reassignment was filed in this case on May 8, 2025, which states that effective June 2, 2025, this action will be reassigned to Judge Julian C. Recana as an individual, direct calendaring judge for all purposes, including trial, in Dept. L.
