TENTATIVE ORDER

On January 26, 2022, this Court STAYED the action on the
condition that Defendant Hermenegildo filed an amended declaration attesting
that he would waive any statute of limitations defense. Upon the filing of such
declaration, this matter was to be stayed pending institution and final
determination of this action in the alternative forum (Mexico). On June 3,
2022, Plaintiff’s Motion for Reconsideration of this Court’s January 26, 2022 Order
was DENIED.

Plaintiff Appealed both Orders. On November 10, 2022, a
Remittitur was issued dismissing Plaintiff’s Appeal.

Since Defendant Hermenegildo’s Amended Declaration attesting
that he waives any statute of limitations defense in this action was filed on
May 3, 2022, this action is STAYED pending institution and final determination
of this action in the alternative forum.

A status conference re: Stay is set for hearing on
Wednesday, August 2, 2023 at 1:30 p.m. in Dept. SE-C. The Case Management
Conference set for April 10, 2023 at 1:30 p.m. in Dept. SE-F is taken
OFF-CALENDAR.
