This medical malpractice action was filed on April 22, 2021. Trial is currently scheduled to begin on June 17, 2025 and a final status conference (FSC) is scheduled for June 2, 2025. Defendant Ray Gonzales (Doe 1) now applies ex parte for an order continuing the trial date for four months. The parties have stipulated to an FSC and trial continuance of four months based on Plaintiff’s counsel requiring an unexpected surgical procedure. (Rabaum Decl., Exh. A.)

Defendant’s ex parte application to continue the trial date and all associated pretrial dates and deadlines is GRANTED pursuant to the parties’ stipulation and Cal. Rules of Court, rule 3.1332(c)(3) - the unavailability of trial counsel because of death, illness, or other excusable circumstances. A trial continuance of four months is reasonable. The Court will confer with the parties to select new trial and FSC dates. Moving party to give notice.
