Plaintiff applies to stay the action or to vacate trial, set for October 5, 2023.  On February 7, 2023, the court entered judgment in favor of Defendant Kangavari after granting a summary judgment.  The remaining defendants are Intercommunity Emergency Medical Group, et al. and PIH Health, et al.  If trial proceeds without defendant Kangavari, the remaining defendants will be barred from attributing fault to him.  The parties have submitted a stipulation to either vacate the trial date and set a CMC date one year from this application, or to stay the action until the court of appeal issues its remittitur.

Plaintiff's ex parte application is GRANTED.  The action is STAYED pending the Court of Appeal's decision.
