Jane Doe vs Roe #1, et al., Case No. 21STCV21402

This is a sexual misconduct lawsuit.  Defendant ABC Unified School District’s ex parte application to advance the hearing date for its motion for stay is DENIED.  Defendant contends that there are pending appellate matters which will soon determine whether Plaintiff’s claims violate the Gift Clause of the California Constitution.  Trial is currently set for May 30, 2024. The motion is currently set for June 25, 2024.  On this record, the Court cannot determine that the appellate ruling Defendant anticipates will in fact occur any time soon.  Defendant’s ex parte application is DENIED.  Defendant is not foreclosed from seeking a trial continuance in Dept. SE-F.
