This is a disability access case. Plaintiff moves ex parte to specially set hearings on shortened notice for Plaintiff’s Motion to Deem Request for Admissions Admitted, Motion to Compel Responses to Request for Production, Motion to Compel Responses to Special Interrogatories, and Motion to Compel Responses to Form Interrogatories. 

The motions are currently set for September 17, 2024, the first available hearing dates when Plaintiff filed them. Trial is currently set for May 15, 2024.  Plaintiff requests that the motions be heard before the April 30 discovery cut-off date.  The Court is unable to accommodate the request. 

The ex parte application is DENIED.  In the alternative, the motions are ADVANCED to this day and CONTINUED to Thursday, June 6, 2024 at 9:30 a.m. in Dept. SE-C.  Opposition and Reply briefs to be filed and served in compliance with the new hearing date.  Plaintiff is not foreclosed from seeking a trial continuance in Dept. SE-F.
