This sexual misconduct case was filed on Jun 28, 2022. Trial is currently scheduled to begin on June 4, 2025. Plaintiff now applies ex parte for an Order to Continue Trial. Plaintiff argues good cause exists because despite diligent efforts, Plaintiff has been unable to locate former classmates who were witnesses to the conduct alleged by Plaintiff. Plaintiff seeks a continuance so that Plaintiff can retain co-counsel with resources to locate these witnesses. There have been two prior trial continuances in this action.

Plaintiff’s ex parte application for an Order to Continue Trial is GRANTED pursuant to California Rules of Court, rule 3.1332(c)(6) - a party's excused inability to obtain essential testimony, documents, or other material evidence despite diligent efforts. A trial continuance of ninety days is reasonable. The Court will confer with the parties to select new trial and FSC dates. The discovery cut-off date and related deadlines will correspond with the new trial date. Moving party to give notice.
