Plaintiff/Cross-Defendant's ex parte application to dismiss Cross-Complaint is DENIED.  Counsel for Defendant/Cross-Complainant suffered a minor stroke on December 27, 2022.  He completed the First Amended Complaint and had his client sign the verification on January 4, 2023.  He does not know why he failed to file it.  Counsel continues to experience symptoms related to his stroke. 

Given counsel's medical condition, leave to file the First Amended Cross-Complaint is GRANTED.  Counsel is ordered to file the First Amended Cross-Complaint within 5 days.  Although counsel asserts that the amended cross-complaint was filed on February 1, 2023, there is no record of any such filing.
