Plaintiff’s Opposition was untimely filed on February 24, 2023. It was supposed to be filed by no later than February 16, 2023. (CCP §1005(b).)

In the interests of justice and to ensure that this matter is adjudicated on the merits, rather than striking Plaintiff’s Opposition, this Court utilizes its discretion to consider the untimely filing. In order to obviate any prejudice to Defendant/Moving Party, this matter is CONTINUED as indicated above. Defendant/Moving Party is granted leave to file a Supplemental/Substantive Reply to be filed and served per Code in accordance with the new hearing date.
