This employment discrimination action was filed on August 4, 2022. Trial is currently scheduled to begin on April 7, 2025. Defendants now move ex parte for an Order to Continue Trial Date. Defendants argue good cause exists because lead trial counsel for Defendants is currently treating an unexpected medical issue that requires a three-to-four-month regimen of chemotherapy which is expected to end mid to late March. In opposition, Plaintiffs argue there are two assigned co-counsel capable of proceeding to trial without prejudice to Plaintiffs and that Defendants have recently used delay tactics in discovery.
Defendants’ ex parte application to Continue Trial Date is GRANTED pursuant to California Rules of Court, rule 3.1332(c)(3) - the unavailability of trial counsel because of death, illness, or other excusable circumstances. A trial continuance to a date after 30 to 60 days is reasonable. The Court will confer with the parties to select a new trial date and FSC date. The discovery cut-off date and related deadlines will correspond with the new trial date. Moving party to give notice.
