ORDER
I.
Plaintiff FINANCIAL
PACIFIC LEASING, INC.’s application
for right to attach order is DENIED without prejudice.
II.
Plaintiff FINANCIAL
PACIFIC LEASING, INC.’s application
for writ of possession is DENIED without
prejudice.
CCP
§482.070 governs service of an application for a right to attach order, and
states: “Except as otherwise provided…legal process required or permitted to be
served under this title may served personally or by mail.”
CCP
§512.030 governs service of an application for a writ of possession and
indicates that the plaintiff must serve the defendant with a copy of the
summons and complaint, a notice of application and hearing, and a copy of the
application for a writ of possession and any supporting declarations before the
hearing.
On
December 1, 2022, this Court CONTINUED these motions because no proofs of
service for the subject applications were on file with the Court prior to the
December 1, 2022 hearing date. As of January 16, 2023, no proofs of service have
been filed. The Applications are DENIED without prejudice.
