Perez v. American Honda Motor Co., Inc. (22NWCV00745)

This lemon law action was filed on August 24, 2022. Trial is set for April 29, 2025. Defendant American Honda Motor Co., Inc. now moves ex parte for a 120-day trial continuance on the following grounds: 1) Defendant’s lead counsel, Theodore Dorenkamp III, is unavailable for trial from April 8, 2025, to April 21, 2025, due to another trial commitment, as well as the week of April 28, 2025, due to travel plans;  2) Defendant’s expert witness was unavailable for his deposition due to another trial commitment; and 3) Defendant’s Motion for Summary Adjudication is set for hearing on May 13, 2025. Defendant asserts it will be prejudiced if its Motion cannot be heard prior to the trial. This is Defendant’s second request for a trial continuance.

Defendant’s Ex Parte Application to Continue Trial and All Related Dates is GRANTED pursuant to Code of Civil Procedure section 437c, subdivision (a)(3). The Court will confer with the parties to select a new trial and final status conference date. Discovery and all trial deadlines will track the new trial date. Moving Party to give notice.
