This lemon law action was filed on September 27, 2022. Trial
is currently scheduled to begin on January 30, 2025, and a final status
conference (FSC) is scheduled for today’s date, January 16, 2025. Plaintiff now
moves ex parte for an Order to Continue Trial. Plaintiff argues that good cause
exists because due to scheduling conflicts, both parties have been unable to
conduct expert depositions. Therefore, Plaintiff argues, the parties would
suffer irreparable harm at trial if they are unable to complete this discovery.
Plaintiff’s Ex Parte Application to Continue Trial is GRANTED
pursuant to California Rules of Court, rule 3.1332(c)(6) - a party's excused
inability to obtain essential testimony, documents, or other material evidence
despite diligent efforts. The Court finds Plaintiff’s request for a continuance
of 90 days reasonable. The Court will confer with the parties to select a new
trial date. The discovery cut-off will track the new trial date. Moving party
to give notice.
