Joseph Construction v. Tran (22NWCV00977)

This breach of construction contract action was filed on October 22, 2022. Trial is set for July 22, 2025. Plaintiff Joseph Construction now moves ex parte to continue trial and all related dates to November 3, 2025, or as soon thereafter as is available.  Plaintiff asserts good causes exists to continue trial because its timely served Motion for Summary Adjudication is currently set for hearing on September 25, 2025, after the trial date. Plaintiff further notes that Defendant Andy Tran has four discovery motions set to be heard in October 2025. Trial has been continued once previously.

 

Plaintiff’s Ex Parte Application to Continue Trial and Related Dates is GRANTED pursuant to Code of Civil Procedure, section 437c subdivision (a)(3). The Court finds is short continuance is warranted to allow Plaintiff’s Motion to be heard more than 30 days before trial. The Court will confer with the parties to select a new trial and final status conference date. Discovery and all trial deadlines will track the new trial date. Moving Party to give notice.
