This lemon law action was filed on December 19, 2022. Trial
is currently scheduled to begin on May 20, 2025. Plaintiffs now apply ex parte
for an order continuing trial to September 17, 2025, or to a date thereafter.
Plaintiffs argue good cause exists because there are multiple upcoming
discovery obligations, such as depositions and vehicle inspections, in which
Plaintiffs’ expert may not be able to attend due to his wife’s illness.
Plaintiffs’ counsel also has a pre-planned wedding set to occur during the trial
date.
Plaintiffs’ ex parte application to continue trial and all
related dates is GRANTED pursuant to California Rules of Court, rule
3.1332(c)(6) - a party's excused inability to obtain essential testimony,
documents, or other material evidence despite diligent efforts. The Court finds
that a trial continuance to a date on or after September 17, 2025 is
reasonable. The Court will confer with the parties to select new trial and FSC
dates. The discovery cut-off date and related deadlines will correspond with
the new trial date. Moving party to give notice.
