This is a
breach of contract action. Defendant and Cross-Complainant Singular
Manufacturing, Inc. moves ex parte for an order to shorten the time for (1) a
Motion for Order Deeming the truth of matters specified in request for
admission, set one, admitted; (2) Motion to Compel Plaintiff’s Answers for From
Interrogatories, Set One; (3) Motion to Compel Plaintiff’s Answers for Special
Interrogatories, Set One; and (4) Motion to Compel Plaintiff’s Answers for
Request for Production of Documents, Set One.
A party may
seek ex parte relief upon an affirmative factual showing "irreparable
harm, immediate danger, or any other statutory basis for granting relief ex
parte." (Cal. R. Ct. 3.1202(c).)
These motions
are currently set on Wednesday August 28, 2024, Thursday January 23, 2025, and
the final two are set for Tuesday, March 4, 2025. Trial is currently set
for October 1, 2024. The Court finds that Defendant would be prejudiced
by not having its discovery motions heard prior to its trial date.
Accordingly,
Defendant’s ex parte application is GRANTED. Defendant’s motions are
ADVANCED to this date and CONTINUED to Thursday, August 29, 2024 at 9:30 a.m.
in Department SE-C.
