This lemon law action was filed on December 21, 2022. Trial is currently scheduled to begin on January 15, 2025. Plaintiffs now move ex parte for an Order to Continue Trial and Expert Related Deadlines to a date in 90 days. Plaintiffs argue good cause exists because neither party has been able to depose each other’s experts. Defendant’s deposition of Plaintiff’s experts was scheduled for December 20, 2024, and Plaintiffs’ deposition of Defendant’s expert was scheduled for December 10, 2024. Both depositions were cancelled due to scheduling conflicts. The parties are conferring on alternative dates.

 

Plaintiffs’ unopposed ex parte application to Continue Trial Date and Expert Related Deadlines is GRANTED pursuant to California Rules of Court, rule 3.1332(c)(6) - a party’s excused inability to obtain essential testimony, documents, or other material evidence despite diligent efforts. A trial continuance to a date on or after 90 days is reasonable. The Court will confer with the parties to select new trial and FSC dates. The discovery cut-off date and expert related deadlines will correspond with the new trial date. Moving party to give notice.
