This breach of contract action was filed on January 25, 2023. Trial is currently scheduled to begin on June 23, 2025 and a Mandatory Settlement Conference (MSC) is scheduled for April 10, 2025. Defendants’ have two motions to compel further discovery scheduled to be heard on April 16, 2025 and a motion for summary judgment scheduled to be heard on May 8, 2025. Defendants now apply ex parte for an order Continuing the MSC so that Defendant’s motions are heard before the MSC. Defendants also state that the parties will be attending a private mediation on May 3, 2025.

Defendants’ ex parte application for an order Continuing the Mandatory Settlement Conference is GRANTED. An MSC continuance to a date after May 8, 2025 and before June 23, 2025 is reasonable. The Court will confer with the parties to select a new MSC date. Moving party to give notice.
