Plaintiff Ma Estela Aguirre’s Motion to
Compel Deposition of Defendant’s Person Most Knowledgeable and Motion to Compel
Further Responses to her Requests for Production of Documents at Deposition are
DENIED as MOOT without prejudice.

Plaintiff Ma Estela Aguirre (Plaintiff) moves
for an order compelling the deposition attendance of Defendant General Motors,
LLC’s (Defendant) Person Most Qualified (PMQ) and for an order compelling
further responses to the related requests for production. Plaintiff seeks
sanctions.
On
February 2, 2023, Plaintiff filed a complaint against Defendant for alleged
violations of the Song-Beverly Act for failure to repair or repurchase
Plaintiff’s vehicle.
Discussion
At the June 21, 2023 Case Management Conference,
the court implemented its standard discovery order in lemon law cases. The June
21 order stayed all pending discovery absent further order of the court or
stipulation of the parties. The discovery requests that are the subject of
these Motions preceded the June 21 order and are stayed. Therefore, these
Motions are DENIED as MOOT.
Similarly, Plaintiff’s request for sanctions is
DENIED as the discovery was stayed.
The court refers the parties to the June 21,
2023 order; specifically, Section 2 (Production of Documents) and Section 4
(Depositions).
