Peter Gonzalez v. City of Los Angeles, et al., Case No. 23NWCV00379

 

This is a trip and fall that occurred on a public sidewalk in the City of Whittier. Defendant LaRue Living Trust owned the residence adjacent to the public sidewalk. It moves ex parte for an order to advance or specially set the hearing on its Motion to Compel Deposition of Plaintiff Petra Gonzalez and Impose Monetary Sanctions, which is currently set for November 19, 2024.

 

A party may seek ex parte relief upon an affirmative factual showing "irreparable harm, immediate danger, or any other statutory basis for granting relief ex parte." (Cal. Rules of Court, rule 3.1202(c).)

 

Defendant La Rue Living Trust contends that Plaintiff has failed to appear for and participate in her deposition or answer questions related to her allegations despite being served with timely and properly served deposition notices. (Déziel Decl., ¶¶ 4-11.) The ex parte application is GRANTED.  Defendant La Rue Living Trust’s Motion to Compel Deposition of Plaintiff Petra Gonzalez is ADVANCED from November 19, 2024 to today’s date and CONTINUED to April 18, 2024 at 9:30 a.m. in Dept. SE-C.
