Edith Rocio Sandoval Sanchez vs. Quy Trac, Case No. 23NWCV01074

 

This is a personal injury action.  Defendant Quy Trac applies ex parte for an order compelling response to Form Interrogatories (Set One), Special Interrogatories (Set One) and Requests for Production of Documents (Set One) propounded upon Plaintiff on March 11, 2024.  No responses have been received to date.  Counsel attempted to reserve a hearing date for the motions, but was informed the earliest hearing date would be in January 2025.  No hearing date has been reserved yet.  Trial is currently scheduled for March 24, 2025.  A party may seek ex parte relief upon an affirmative factual showing "irreparable harm, immediate danger, or any other statutory basis for granting relief ex parte." (Cal. Rules of Court, rule 3.1202(c).) The Court determines that Defendant has not demonstrated irreparable harm.  The ex parte application is DENIED.  Defendant is not foreclosed from seeking a trial continuance in Dept. F.  Counsel is advised that the Court typically requires parties to reserve a hearing date through the Court’s reservation system and then move for ex parte relief if necessary.  Moving party to give notice.
