This lemon law action was filed on April 27, 2023. Trial is currently scheduled to begin on February 24, 2025. Defendant Mike Thompson Recreational Vehicles (MTRV) now applies ex parte for an order to Vacate and Continue Trial Date and All Related Dates. MTRV states that Defendant Eclipse Recreational Vehicles, Inc. (Eclipse) went out of business, which ended the defendants’ joint defense and caused MTRV to substitute its counsel. MTRV argues good cause exists so that it may prepare for trial with its new counsel. MTRV indicates that neither Plaintiff nor Eclipse oppose this application.

 

MTRV’s Ex Parte Application to Vacate and Continue Trial Date and All Related Dates is GRANTED pursuant to California Rules of Court, rule 3.1332(c)(4) - the substitution of trial counsel, but only where there is an affirmative showing that the substitution is required in the interests of justice. A trial continuance to a date after July 1, 2025, is reasonable. The Court will confer with the parties to select new trial and FSC dates. The discovery cut-off date and related deadlines will correspond with the new trial date. Moving party to give notice.
