This lemon law action was filed on May 22, 2023. Trial is currently scheduled to begin on May 19, 2025. Defendant’s Motion for Summary Judgment is scheduled to be heard after trial, on August 12, 2025. Defendant now applies ex parte to Continue Trial and All Related Dates, or alternatively, advance the hearing on Defendants’ Motion for Summary Judgment. Defendant argues good cause exists because Defendant’s Motion for Summary Judgment was timely filed, and new case law decided after the filing of the instant complaint is dispositive in this case. (See Rodriguez v. FCA US, LLC, S274625. WL 4631069 (Oct. 31, 2024).) In response, Plaintiffs state that they do not oppose a trial continuance but do oppose Defendant’s alternative request to advance Defendant’s Motion for Summary Judgment.

 

Defendants’ ex parte application to Continue Trial and All Related Dates is GRANTED. Based on the trial continuance, Defendants’ alternative request to advance the hearing date on their Motion for Summary Judgment is DENIED. A trial continuance to a date after November 24, 2025 is reasonable. The Court will confer with the parties to select new trial, MSC, and FSC dates. The discovery cut-off date and related deadlines will correspond with the new trial date. Moving party to give notice.
