This personal injury action was filed on June 9, 2023. Trial is scheduled to begin on July 10, 2025 in Dept. R. 

 

Defendants Hansen Nguyen and Andrew Nguyen now move ex parte to continue the trial date for approximately 90 days because discovery is incomplete, and "defense counsel Jeffrey Smith has recently given notice at O'Shea & Schabacker and his last day is June 26, 2025. Time is needed for new defense counsel to take over the defense of this case." (Notice 2:8-16). 

 

Defendants' Ex Parte Application to Continue Trial and All-Related Deadlines is GRANTED pursuant to CRC Rule 3.1332(c)(6)-- a party's excused inability to obtain essential testimony, documents, or other material evidence despite diligent efforts. Depending on the Court and the parties' availabilities, a continuance of trial to a date on or about October 2025 is reasonable. The Court will confer with the parties to select new Mandatory Settlement Conference, Final Status Conference and Trial Dates. All pre-trial deadlines, including the discovery cutoff date, are extended to track the new trial date. 

 

The Court notes that a Notice of Reassignment was filed in this case on May 5, 2025, which states that effective June 2, 2025, this action will be reassigned to Judge Brian F. Gasdia as an individual, direct calendaring judge for all purposes, including trial, in Dept. R.
