v. Capital Logistics & Warehousing Group, Inc. (23NWCV02234)
This breach of contract
action was filed on July 19, 2023. The Cross-Complaint was filed on October 13,
2023. Trial is set for April 15, 2025. Defendant Capital Logistics &
Warehousing Group, Inc. now moves ex parte to continue trial to a date after April
23, 2025. Defendant asserts that one of its witnesses, Sunil Dhanraj, Vice
President of Capital Logistics & Warehousing Group, Inc., will be out of
the country due to a family health emergency from April 13, 2025 to April 23,
2025. Mr. Dhanraj has sat for two depositions in this matter. Defendant asserts
that Mr. Dhanraj will need to review documents, photos, and at least one video
as part of his testimony, which cannot be facilitated through a remote
appearance.
Defendant’s Ex Parte
Application for an Order Continuing the Trial Date is GRANTED, pursuant to CRC
Rule 3.1332(c)(1)—the unavailability of an essential lay or expert witness
because of death, illness, or other excusable circumstances. The Court finds a short
trial continuance is warranted. The Court will confer with the parties to
select a new trial and final status conference date. Discovery and
all trial deadlines will track the
new trial date. Moving Party to give notice.
