This action was filed on August 4, 2023. Plaintiff's Motion to Continue Trial is scheduled to be heard on January 21, 2025. Trial is scheduled to begin on March 7, 2025. There are two discovery motions set to be heard after trial on September 10, 2025 and October 8, 2025. Plaintiff's Motion for Leave to File an Amended Complaint is scheduled to be heard after trial on September 11, 2025. 

Plaintiff now moves ex parte to continue trial and all related dates.  Plaintiff's Ex Parte Application is GRANTED pursuant to CRC Rule 3.1332(c)(6)- a party's excused inability to obtain essential testimony, documents, or other material evidence despite diligent efforts. A continuance to a date on or after October 13, 2025 is reasonable depending on the Court and parties' availabilities. The Court will confer with the parties to select new Final Status Conference and Trial dates. The discovery and all related deadlines will track the new trial date. The hearing for Plaintiff's Motion to Continue Trial scheduled for January 21, 2025 is VACATED. Moving Party to give notice.
