This breach of lease action was filed on September 7, 2023.
Trial is set for August 4, 2025. Defendants Lexington Insurance Company and
Western World Insurance Company now move ex parte for an order continuing trial
or vacating trial, or in the alternative, for an order specially setting a
hearing on a motion to continue trial. Defendants assert that a trial
continuance is warranted for the following reasons: 1) Defendants have two
pending discovery motions against Plaintiff Amaryllis Partners, LLC that are
scheduled for May 7, 2025, which is 3 weeks after the MSJ cutoff date, 2)
Plaintiff has four discovery motions set for April 29, 2025, which is 2 weeks
after the MSJ cutoff date, and 3) Defendant Falls Lake National Insurance has a
demurrer scheduled for November 19, 2025, which is after trial.
Defendants’ Ex Parte Application for an Order
to Continue Trial is GRANTED pursuant to CRC Rule 3.1332(c)(6)—A
party's excused inability to obtain essential testimony, documents, or
other material evidence despite diligent efforts. The Court finds the pending
motions warrant a trial continuance. The Court will confer with the parties to
select a new trial and final status conference date. Discovery and
all trial deadlines will track the new trial date. Moving
