The Demurrer and Motion to Strike are MOOT.

Plaintiff to give notice.

This is a lemon law action. Plaintiff Claudia Patricia Amaya Solano filed this action on September 11, 2023. Plaintiff filed causes of action for: (1) Breach of Express Warranty; (2) Breach of Implied Warranty; (3) Violation of the Song-Beverly Act Section 1793.2; and (4) Fraudulent Inducement-Concealment.

Defendant generally demurs to fourth cause of action.

On April 19, 2024, instead of filing an opposition, Plaintiff filed a request for dismissal without prejudice as to the fourth cause of action of action, fraudulent inducement-concealment, and punitive damages.  The instant motions were directed to the dismissed fourth cause of action.   

Accordingly, the Demurrer and Motion to Strike are deemed MOOT.
