Gluck v. Christensen (23NWCV03298)
This sexual assault case was filed on October 12, 2023. Trial is
set for April 29, 2025. Defendant Guy Christensen’s Motion to Compel Further
Deposition Testimony and Production of Documents as to Plaintiff Jean Gluck is
currently set for hearing on July 8, 2025. Defendant now moves ex parte for an
order continuing trial, or in the alternative, for an order shortening the time
to hear the Motion to Compel. Defendant asserts that Plaintiff failed to
produce certain documents at her deposition on March 17, 2025 and made
meritless objections. Defendant argues good causes exists to continue trial so
that Defendant’s Motion to Compel can be heard prior to trial. Defendant
asserts that a trial continuance will not prejudice the parties and will allow
Defendant to complete discovery. Trial has not been continued in the past.
Defendant’s Ex Parte Application to Continue Trial is GRANTED,
pursuant to CRC Rule 3.1332(c)(6)- A party's excused inability to obtain
essential testimony, documents, or other material evidence despite diligent
efforts. The Court will confer with the parties to select
new trial and final status conference dates. Discovery and
all trial deadlines will track the new trial date. Moving
Party to give notice.
