Marisa Torres, et al. vs McDonald’s Restaurants of California, et al., Case No. 23NWCV03502

This is a personal injury action.

 

Plaintiffs Marisa Torres and Liam Torres (collectively “Plaintiffs”) apply ex parte for an order advancing the hearing date set for Plaintiffs’ Motion for an Order Compelling Defendant N.L.C. Enterprises to Provide Further Responses to Plaintiff’s Requests for Production, Set One, and Motion for an Order Compelling Further Responses to Plaintiff’s Special Interrogatories, Set One.

 

A party may seek ex parte relief upon an affirmative factual showing "irreparable harm, immediate danger, or any other statutory basis for granting relief ex parte." (Cal. R. Ct. 3.1202(c).)

 

The two motions to compel further responses are currently set for Wednesday, March 12, 2025. The jury trial is currently scheduled for August 12, 2024.  The Court cannot accommodate the hearings before the trial date.  The Court notes there are various other motions scheduled for October and December 2024. 

 

Accordingly, Plaintiffs’ ex parte application to advance the hearing dates for the Motion for an Order Compelling Defendant N.L.C. Enterprises to Provide Further Responses to Plaintiff’s Requests for Production, Set One, and Motion for an Order Compelling Further Responses to Plaintiff’s Special Interrogatories, Set One is GRANTED in part.  The motions are advanced to this date and CONTINUED to Thursday, October 17, 2024 at 10:30 a.m in Department SE-C, to be heard together with Defendants’ Motion to Strike.  The parties are not foreclosed from seeking to continue trial in Dept. SE-F.
