Case Number: 23NWV00329 Hearing Date: August 9, 2024 Dept: C
Shah, et al. vs. J.R. Republic, Inc., et al., Case No. 23NWCV00329
This is a personal injury lawsuit. Defendants apply ex parte to advance the hearing on their motion to compel Plaintiff Syed Fakhar Shah’s deposition. The hearing is currently set for April 9, 2025. Defendants argue that because trial is set for October 23, 2025, and discovery cutoff is September 23, 2025, Defendants will have less than four months to complete further discovery, including any necessary independent medical examinations. Defendants assert that they need to depose Plaintiff to assess Plaintiff’s injuries, complaints, and treatment, which will determine if any independent medical examinations will be necessary. Defendants’ ex parte application is GRANTED. Defendants have not demonstrated irreparable harm. However, in the exercise of the Court’s discretion, the motion to compel deposition is ADVANCED from April 9, 2025 to today’s date and CONTINUED to November 6, 2024 at 9:30 a.m. in Dept. SE-C. The ex parte application is deemed to be the moving papers. Opposition and Reply briefs to be filed and served in compliance with the new hearing date. Moving party to give notice.
