Station 11 LLC vs Arayna Hedgepeth, Case No. 24NWCV00031

This is an unlawful detainer action.  Plaintiff Station 11 LLC applies ex parte to Enforce the Stipulated Agreement.  The Agreement calls for Defendant to vacate the premises and pay reduced damages in the amount of $5,562.00.  Defendant has failed to make the agreed upon payments of $900 per month.  However, Defendant has vacated the premises, and Defendant’s only outstanding obligation is payment of money damages.  Thus, Plaintiff has failed to demonstrate irreparable harm or immediate danger. (Cal. Rule of Court, Rule 3.1202(c).)  The ex parte application is DENIED.  Plaintiff is not foreclosed from filing a noticed motion.
