This is an unlawful detainer action. Plaintiff Del Rio 7444, LLC moves ex parte for an order shortening time to hear its motion for summary judgment, which is currently set for May 21, 2024.

A party may seek ex parte relief upon an affirmative factual showing "irreparable harm, immediate danger, or any other statutory basis for granting relief ex parte." (Cal. Rules of Court, rule 3.1202(c).)

Plaintiff asserts that its motion for summary judgment should be heard before trial. (Decl. Andrews, ¶ 4.) However, the court has not set a trial date. Therefore, Plaintiff’s ex parte application is DENIED.
