This personal injury action was filed on February 2, 2024. Trial is scheduled to begin on March 25, 2025. Defendants now move ex parte to continue trial to a date on or about April 28, 2025, and for the discovery cutoff date to correspond with the continued hearing date. Defendants contend that a brief continuance is necessary because lead counsel for Defendants has a a prepaid trip to New Zealand and Australia from March 24, 2025 to April 8, 2025 which conflicts with his ability to adequately prepare for trial as scheduled. In their Ex Parte Application, Defendants state that "[t]he parties have stipulated to continue the trial...." (Ex Parte 4:7-8.)

Defendants' Ex Parte Application to Continue Trial to a date on or after April 28, 2025 is GRANTED pursuant to CRC Rule 3.1332(c)(3)- the unavailability of trial counsel because of excusable circumstances. The Court will confer with the parties to schedule new Final Status Conference and Trial dates. Discovery and motion deadlines will track the new trial date. Moving Party to give notice.
