Defendant’s Motion is DENIED for failure to comply with CRC Rule 3.1345, which requires that a Separate Statement be filed whenever a discovery motion involves the contents of a discovery request. (See CRC Rule 3.1345(a)(3).)  “A separate statement is a separate documents filed and served with the discovery motion….” (CRC Rule 3.1345(c).) The filing and service of a separate statement is mandatory; compliance is not optional.
