This is an unlawful detainer action.  Plaintiff Cerritos Retail Centercal, LLC moves ex parte for an order shortening time on Defendant’s Motion to Quash Service of Summons and Complaint.

The hearing is currently set for Wednesday, January 29, 2025. Unlawful detainers are summary proceedings entitled to priority in trial setting. (CCP § 1170.5 and 1179(a).) CCP § 1167.4(a) states that hearings on motions to quash in unlawful detainer actions should be heard within three to seven days after the filing date of the Motion to Quash.

The ex parte application is GRANTED.  Defendant’s Motion to Quash is ADVANCED from January 29, 2025 to this date and CONTINUED to Thursday, May 9, 2024 at 9:30 a.m. in Department SE-C.  Plaintiff’s Opposition was filed on April 30, 2024.  Defendant’s Reply is due May 6, 2024.
