Fuentes v. Toyota Motor Sales, U.S.A., Inc., et al. (24NWCV01032)

This lemon law action was filed on April 4, 2024. Trial is set for March 25, 2025. Defendants Toyota Motor Sales, U.S.A., Inc. (“TMS”) and D. Longo, LLC now move ex parte to continue trial to May 2025 or a date convenient to the Court. Defendants assert good cause exists to continue trial because Defendant TMS, TMS’ person most knowledgeable (PMK) witness, and the lead trial counsel will be engaged in another trial during the current trial date. Trial has not been continued previously. Plaintiff’s counsel is unwilling to stipulate to a continuance.

Defendants’ Ex Parte Application to Continue Trial is GRANTED pursuant to CRC Rule 3.1332(c)(1)-(3). A trial continuance to a date in May or a date thereafter is reasonable. The Court will confer with the parties to select new trial and final status conference dates. Discovery and all trial deadlines will track the new trial date. Moving Party to give notice.
