Plaintiff’s unopposed application for writ of possession as to Defendant YANI ZOU is CONTINUED to Thursday, September 12, 2024 at 10:30 a.m. in Dept. SE-C.

Plaintiff BMW BANK OF NORTH AMERICA (“Plaintiff”) applies for a writ of possession against Defendant YANI ZOU. (“Defendant”)  pursuant to CCP §512.010. 

Prior to the hearing, the defendant shall be served with all of the following: (a) a copy of the summons and complaint; (b) A Notice of Application and Hearing; and (c) a copy of the application and any affidavit in support thereof.  (CCP §512.030.) 

The Declaration of Due Diligence filed on May 24, 2024 shows that Defendant has not been served with all necessary documents.

This matter is CONTINUED as indicated above to ensure that Defendant is served with all necessary documents prior to the hearing. Plaintiff/Moving Party is ORDERED to file a Proof of Service, showing that Defendant has been served and provided notice of the continued hearing, no later than the due date for moving papers as set forth in CCP §1005(b).  Opposition and Reply may be filed and served per Code in accordance with the new hearing date.
