National Commercial Recovery, Inc. vs. C&B Croissants, Inc., Case No. 24NWCV01795

This is an action for common counts between two businesses. Plaintiff moves ex parte to enforce the settlement agreement against Defendants under Code of Civil Procedure section 664.6.  Plaintiff contends that on August 21, 2024, the parties entered into a conditional settlement which required Defendants to make weekly payments beginning on August 22, 2024, and ending on November 7, 2024 for a total sum of $35, 292.05.  Defendants have not made any payments to date. 

The ex parte application is DENIED.  In the alternative, the Court specially sets a hearing on Plaintiff’s motion to enforce settlement agreement on October 9, 2024 at 9:30 a.m. in Dept. SE-C.  The ex parte application is deemed to be the moving papers.  Opposition and Reply briefs to be filed and served in compliance with the new hearing date.
