This commercial unlawful detainer action was filed on July 29,
2024. Trial is scheduled to begin today, January 30, 2025. Plaintiff's Motion
for Summary Judgment scheduled to be heard after trial on February 19, 2025. At
7:04 a.m. this morning, Defendant Furniture Delivery Solutions, Inc. FILED
Defendant's Motion for Summary Judgment which is scheduled to be heard after
trial on Thursday, August 7, 2025.
Defendant now moves ex parte to continue trial for the following
reasons: (1) To ensure that Defendant's Motion for Summary Judgment (filed this
morning at 7:04 a.m., Reservation # 783524082961) is heard before trial; (2)
Defendant argues that Plaintiff has refused to produce its witness for a duly
noticed deposition scheduled for January 28, 2025; (3) Trial Counsel for
Defendant was on a pre-planned trip to Israel from December 22, 2025 until
January 23, 2025 and needs additional time to prepare for trial; and (4) The
case is not yet ready for trial because Plaintiff's deposition has not yet been
taken.
In addition to this subject Ex Parte Application to continue the
trial date, Defendant also moves ex parte to advance the reservation date
on Defendant's Motion for Summary Judgment to be heard before trial-- which is
currently pending in Dept. C.
Defendant's Ex Parte Application to Continue Trial and All Related
Deadlines is DENIED. Good cause has not been shown. At this time, there
are no motions to compel discovery that have been filed or scheduled with this
Court. Defendant's dilatory acts do not support a finding of exigency here. Plaintiff
to give notice.
