TENTATIVE RULING:

TR:  Defendant's ex parte is DENIED.  The case has already been assigned to Dept. L for trial.  Discovery cut-off on "discovery proceeding has already passed and,  Defendant's ex parte is DENIED on the merits.  The basis for the ex parte application is the Order was silent on the issue of evidence sanctions.  Contrary to Defendant's contention, the Order specifically states, "Defendant Walsh Sea Corridor Constructors' motion for monetary and evidence sanctions is DENIED."  Therefore, the basis for the application does not exist.
