Judge: Linda S. Marks, Case: 01124125, Date: 2022-08-01 Tentative Ruling

Plaintiff’s Motion for Attorney Fees

Plaintiff obtained Judgment in Plaintiff’s favor and against Defendants Abdul Basir Hafizi and H.B.A. Electrical. as to Plaintiff’s Fourth Cause of Action for Violations of Business & Professions Code section 7031 which provides for recovery of compensation paid to an unlicensed contractor. (See Ex. A to Declaration of Howard D. Hall.) Thus, Plaintiff is entitled to attorney’s fees under Code of Civil Procedure section 1029.8. The maximum allowable amount is $10,000.

The hourly rates for the three attorneys and paralegals handling the case as Plaintiff’s counsels appear to be reasonable. The fees were ultimately discounted to $30,429.96. (Declaration of Howard D. Hall, ¶¶ 2-6.) Thus, attorneys’ fees in the amount of $10,000 is reasonable.

Tentative Ruling: Plaintiff/Cross-Defendant, Pilar Dean’s Motion for Attorneys’ Fees in the amount of $10,000 against Defendant H.B.A. Electrical is GRANTED.

Plaintiff to give notice.
